These Terms of Use ("Terms") govern your access to and use of ThriftVal ("ThriftVal," "we," "us," or "our") at thriftval.com, including the mobile Evaluator and related features. By using ThriftVal, you agree to these Terms. If you do not agree, do not use the service.
What ThriftVal provides
ThriftVal helps you estimate potential resale value for secondhand items by analyzing photos you provide and searching publicly available marketplace data. Results are estimates for informational purposes only. ThriftVal does not buy or sell items, process payments, or guarantee that you will achieve any particular sale price or profit.
Eligibility
You must be at least 13 years old to use ThriftVal. If you are under 18, you represent that you have permission from a parent or legal guardian. The Evaluator is intended for use on a mobile device with a camera.
Your responsibilities
When using ThriftVal, you agree that you will:
- Upload only photos you have the right to use (for example, photos you took or own).
- Not upload unlawful, harmful, or infringing content, or content that violates another person's privacy.
- Not attempt to reverse engineer, scrape, overload, or disrupt the service or its APIs.
- Use valuations as one input among many — not as financial, legal, or professional advice.
No guarantee of accuracy
Market prices change quickly. Comparable listings, AI-detected attributes, and fee calculations may be incomplete or incorrect. ThriftVal provides estimates based on available data at the time of your request. You are solely responsible for purchase, pricing, and resale decisions.
Third-party services and links
ThriftVal relies on third-party APIs and marketplaces (including AI, search, and listing data providers). We do not control third-party services and are not responsible for their availability, accuracy, terms, or policies. Links to external sites are provided for convenience and do not imply endorsement.
Intellectual property
ThriftVal, its logo, branding, software, and content are owned by us or our licensors and are protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use ThriftVal for personal, non-commercial resale research. You may not copy, modify, distribute, or create derivative works from the service except as permitted by law.
You retain ownership of photos you upload. You grant us a limited license to process those photos solely to provide the service, including transmitting them to our subprocessors as described in our Privacy Policy.
Disclaimer of warranties
THRIFTVAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIFTVAL AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THRIFTVAL WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless ThriftVal and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service, your uploaded content, or your violation of these Terms.
Suspension and termination
We may suspend or discontinue ThriftVal, or restrict access, at any time for maintenance, abuse prevention, legal compliance, or any other reason. You may stop using the service at any time.
Changes to these Terms
We may update these Terms from time to time. We will revise the "Last updated" date when we do. Continued use after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the State of New Jersey, without regard to conflict-of-law principles, except where mandatory local law applies.
